Terms

The rules of the sale.

What you agree to when you order, in one place.

Last updated: 2026-10-10

These terms (the "Terms") apply to every order you place at kendamasenses.com. By placing an order you confirm that you have read and accepted these Terms.

1. Who you are buying from

Belangstellend Beleven (trading as Kendama Senses)
Grote Voort 10, 8041 AM Zwolle, Nederland
KvK: 80641482 · BTW: NL003470779B69
Contact: info@kendamasenses.com

2. Definitions

  • "Consumer": a natural person acting outside their trade, business or profession.
  • "Business customer": anyone ordering in the course of a trade, business or profession.
  • "Order": a request placed through our checkout to buy one or more products.

3. The agreement

A purchase agreement is formed when we send you an order confirmation by email after we have received your payment. We may decline an order without giving reasons (e.g. stock errors, suspected fraud); if we do, any payment already received will be refunded in full.

Product information, photos and prices on the site are kept as accurate as possible but are not binding offers. Obvious errors (typos, mispriced items, etc.) do not bind us.

4. Prices & payment

  • The price you see already includes tax. For orders shipped within the EU, that is VAT at your own country's rate, not the Dutch rate. Orders shipped outside the EU are not charged EU VAT.
  • Shipping costs are added at checkout.
  • For orders shipped outside the EU, you may be liable for additional import duties or local taxes on delivery.
  • We accept the payment methods listed at checkout. Payment is processed through Shopify Payments and PayPal.
  • Title to the goods passes to you only when full payment has been received.

5. Delivery

We show two dates for every order: an estimated arrival, and, when we have enough delivery history for your country, a guaranteed date.

The estimated arrival is our current best guess. It is not a promise.

The guaranteed date is a promise: if your parcel has not had its first delivery attempt (or reached the pickup point) by that date, email us and we refund your shipping.

Orders to the United States. The price covers shipping only. Please be aware that UPS bills you the US import duty and its customs fees before or during delivery. UPS usually delivers 3 to 6 business days after we ship. This is an estimate based on recent parcels, not a promise. If you refuse the parcel, for example because you do not want to pay the import charges, UPS sends it back to us. We refund your order minus the original shipping cost and the return shipping UPS bills us.

  • Provided we have a complete, correct delivery address.
  • On time means the carrier's first delivery attempt, or your parcel reaching the pickup point.
  • Counted from your order's promised ship day, the next Monday or Thursday after you order. A hold on the order, whether waiting on payment, a fraud check, an address fix, or combining it with another order, pushes the clock to the new ship day instead.
  • Provided delivery was not affected by a carrier disruption we can point to, such as a strike, network outage, natural disaster, or government action.
  • Claims within 30 days of the guaranteed date.
  • Outside the EU, customs may ask you to pay import charges before releasing your parcel. Time spent waiting for that payment does not count.
  • If your order had free shipping, we refund what shipping would have cost.

The date that counts is the one in your order confirmation email, worked out from the address your order actually ships to. A date shown earlier, including in the cart before you paid, does not bind us.

We may extend the guaranteed date during busy periods, such as a major sale. A later date only ever applies to orders placed after the change.

The list above is the complete list of exceptions to this guarantee. We will not use Section 11 (events outside our control) to get out of it on some other ground.

If we cannot deliver at all within 30 days of the order, you may cancel the agreement and receive a full refund.

For a Consumer purchase, which is almost every order placed here, risk of loss or damage passes only when the product physically reaches you (Art. 7:11 BW). For a Business customer order, risk passes on delivery, or on first-attempted delivery.

6. Right of withdrawal (consumers only)

As a Consumer you have the right to withdraw from the agreement within 14 days of receiving the goods, without giving any reason. We apply this to every order, wherever you are, and to everything we sell. This is the "cooling-off period" under the Dutch Wet Koop op Afstand / EU Consumer Rights Directive / UK Consumer Contracts Regulations.

How to withdraw

  1. Notify us of your decision before the 14 days are up, by email to info@kendamasenses.com or using the EU model withdrawal form (we will send it on request).
  2. Return the product within 14 days of giving us notice. We send you a shipping label; the cost of that label comes off your refund. Pack it carefully. You are liable for any loss in value caused by handling beyond what is necessary to inspect the product.
  3. We refund the purchase price and the original (cheapest) shipping cost within 14 days of receiving the return (or proof of return, whichever is sooner), via the same payment method you used.

Diminished value from use beyond inspection

You may unpack a kendama and handle it to check that it is what you ordered, much like you would in a physical shop. Acceptable handling includes:

  • removing it from the box and packaging,
  • checking the wood, paint, string and bearing,
  • holding it with clean hands, and tossing the ken or tama and catching it in your hand to feel the weight.

Anything more than that is "use," not "inspection." Playing a kendama, even carefully, leaves marks: the spike dents the tama from the very first session, and the cup edges show wear soon after. Under Dutch and EU consumer law (Art. 7:18 lid 4 BW), you remain liable for any loss in value caused by handling beyond what was needed to inspect the product.

If you exercise your right of withdrawal on a kendama showing signs of play, we will refund the price minus the diminished value. A kendama carrying those marks cannot be sold again and has no resale value to us, so for a played kendama that deduction comes to the full purchase price.

If a product fails or is faulty beyond normal play wear, see Section 7. That's a warranty issue, not a withdrawal issue, and we'll work with you on repair, replacement or refund.

7. Statutory warranty (consumers)

Under Dutch and EU law you are entitled to receive products that conform to the agreement (Art. 7:17 BW). If a product is defective, contact us at info@kendamasenses.com and we will work with you on repair, replacement, or refund. This statutory warranty applies in addition to (and is not limited by) any commercial guarantee.

For UK Consumer Rights Act buyers: the statutory rights to product quality, fitness for purpose, and matching description apply.

In practice: email us photos within a month of receiving the product and we will sort out a new one or a refund. We judge these from the photographs, and after a month of play a kendama carries enough marks that a fault and ordinary wear start to look alike, which is why we ask early. Where the fault is genuine we cover the costs, including the postage back to us. Wear from normal play is not a fault, so it is not replaced.

8. Liability

Nothing in these Terms limits liability for death or personal injury caused by our negligence, fraud, or any liability that cannot be excluded under applicable law (e.g. statutory consumer rights).

Subject to that, our total liability for any claim arising from an order is limited to the amount you paid for the order.

We are not liable for indirect or consequential losses, including loss of profits or data.

9. Intellectual property

Our own text, photography, the site design, and the "Kendama Senses" name and logo are ours. Other brand names, logos and product photos on the site belong to those brands; we show them only to present and sell their products.

Buying a product does not give you any right to use our name, logo, or other IP beyond the personal use of the product itself.

10. Privacy

Your personal data is handled in accordance with our Privacy Policy.

11. Force majeure

We are not liable for failure to perform the agreement caused by events beyond our reasonable control (Art. 6:75 BW), including but not limited to carrier strikes, natural disasters, government restrictions, or major IT outages.

12. Complaints & dispute resolution

If something is wrong with your order, please email info@kendamasenses.com first. We'll work to fix it quickly. If we cannot reach an agreement:

  • You always retain the right to bring a claim before the competent court in your country of residence.

13. Applicable law & jurisdiction

These Terms are governed by Dutch law. The application of the United Nations Convention on Contracts for the International Sale of Goods (CISG) is excluded. Disputes will be brought before the competent court in the district of Midden-Nederland (Utrecht), unless mandatory consumer law gives you the right to a different forum (in which case that right prevails).

14. Changes to these Terms

We may update these Terms from time to time. The version that applies to your order is the one published on the site at the moment your order is placed. The "Last updated" date above reflects the most recent revision.

15. Severability

If any provision of these Terms is held invalid or unenforceable, the remaining provisions remain in full force; we will replace the invalid provision with one that comes closest to its intended effect.
